Terms of Service

These terms govern the services provided by The Curb Agency ("we," "us") to you ("client"). By subscribing to our services, you agree to these terms. We've written them in plain English on purpose.

Services

Your subscription includes:

• A professionally designed, mobile-ready website hosted on a fast global network.
• Your own custom domain (purchased and managed by you, or we can help).
• Ongoing edits and updates — send us changes and we'll apply them within 2 business days.
• Google presence optimization, including help with your Google Business Profile.
• Hosting, security, and maintenance for as long as you subscribe.

There are no setup fees or long-term contracts. You pay month-to-month at the rate agreed upon when your service begins.

What's not included

• Domain registration fees (typically $10–20/year — you pay this directly).
• Paid advertising (Google Ads, Facebook Ads, etc.).
• Custom software development or e-commerce beyond a basic contact form.

Payment

We charge your agreed monthly fee via credit or debit card through Stripe. Your first payment is due when your site goes live. Subsequent payments are charged automatically on the same day each month.

If a payment fails, we'll notify you and give you 7 days to update your payment method before service is paused.

Cancellation

There is no contract. You can cancel at any time by emailing mtiojanco@kalamazoogourmet.com. There are no cancellation fees.

Payments are non-refundable and are not prorated. When you cancel, your service and website will remain active through the end of your current billing period, then be taken offline.

We'll provide an export of your site content on request.

What happens to your site if you cancel

We retain the right to take the site offline after the subscription ends. The design, code, and copy we produced for your site are our property unless separately agreed in writing — but the content you provided (your business name, photos, contact information) is yours and we'll return it to you on request.

Your responsibilities

• Provide accurate business information for your site.
• Tell us promptly if your hours, services, or contact details change.
• Ensure you have rights to any photos or content you provide to us.

Our responsibilities

• Keep your site live and fast.
• Apply your requested edits within 2 business days.
• Notify you of any planned downtime in advance.
• Keep your contact information and business data confidential.

Limitation of liability

The Curb Agency is not liable for lost revenue or business impacts arising from website downtime, search engine ranking changes, or other factors outside our direct control. Our total liability is limited to the fees you paid in the most recent billing period.

Changes to these terms

We may update these terms with 30 days' advance notice by email. If you continue your subscription after the notice period, you accept the updated terms. If you disagree, you may cancel without penalty.
